Overview

Requirements

  1. A qualifying corporate relationship

    The qualifying foreign enterprise and the U.S. entity must share a recognized corporate relationship, such as a parent company, branch, subsidiary, or affiliate.

  2. One year of prior employment abroad

    The employee must have been continuously employed abroad by the qualifying foreign entity for at least one continuous year within the three years immediately preceding the petition.

  3. L-1A — executive or managerial capacity

    For the L-1A Executive/Managerial subcategory, the employee must perform executive duties or manage major organizational functions and personnel.

  4. L-1B — specialized knowledge

    For the L-1B Specialized Knowledge subcategory, the employee must possess advanced, proprietary knowledge of the company’s products, services, proprietary processes, or international systems.
