Overview

The EB-1 Employment-Based First Preference category represents the premier green card pathway for individuals of extraordinary ability, outstanding university professors and researchers, and foreign corporate executives or managers. Because EB-1 foreign national applicants represent top talent in their respective fields, Congress allocated this category high visa priority, often avoiding immigrant visa backlogs.

Requirements

  1. EB-1A — Extraordinary Ability

    Requires documentation showing national or international acclaim in science, arts, education, business, or athletics through major awards or meeting three out of ten regulatory criteria. No employer sponsor or PERM labor certification is required; individuals may self-petition.

  2. EB-1B — Outstanding Professors & Researchers

    Requires international recognition in an academic field, at least three years of research or teaching experience, and a permanent, tenure-track job offer from a U.S. university or private employer.

  3. EB-1C — Multinational Executives & Managers

    Requires at least one year of managerial or executive employment with an affiliated foreign company within the preceding three years, accompanied by a managerial or executive offer from a qualifying U.S. affiliate.
